1 ABOUT CPH.DK/SHOP

These terms and conditions apply to your pre-ordering or purchase via cph.dk/shop. The terms and conditions do not apply to purchases made in stores in Copenhagen Airport.

cph.dk/shop is an online platform where you can pre-order and buy goods from the TAX FREE shops in Copenhagen Airport. cph.dk/shop is prodided by by Copenhagen Airports A / S, Lufthavsboulevard 6, 2770 Kastrup, CVR no. 14707204, ("CPH").

It is a prerequisite for pre-ordering or purchasing goods at cph.dk/shop that you are 18 years old and have a valid travel document in the form of a flight ticket from Copenhagen Airport or another valid access document to the airside area (area after security) at Copenhagen Airport .

CPH may at any time change the terms and condition by updating this page.

These terms and condition are last amended on 15 November 2017.

2. WITH WHOM AM I ENTERING INTO A CONTRACT WITH?

WHEN PRE-ORDERING OR PURCHASING GOODS VIA CPH.DK/SHOP, YOU ARE ENTERING INTO AN AGREEMENT WITH GEBR. HEINEMANN RETAIL ApS, VESTVEJ 6, 2770 KASTRUP, CVR-NR: 29605556, ("Heinemann"), WHOS IS THE CURRENT PROVIDER OF THE TAX FREE SHOPS AT COPENHAGEN AIRPORT. CPH IS ONLY THE PROVIDER OF THE WEBSITE, CPH.DK/SHOP, AND IS NOT THE SELLER OF THE GOODS.

CPH IS NOT LIABLE FOR ANY CLAIMS ARISING OUT OF OR IN RELATION TO THE PURCHASE.

3. PRE-ORDERING VIA CPH.DK/SHOP

Via cph.dk/shop you can pre-order goods for pick up in the TAX FREE Main Store at CSC, the TAX FREE Shop in Terminal 3 or in TAX FREE Arrival Store at Copenhagen Airport or you can purchase the goods online. When you purchase goods online, either you can pick up the goods in the the aforementioned TAX FREE shops at Copenhagen Airport, or you can have it sent to the delivery address specified by you in the order. You can read more about purchases via cph.dk/shop under clause 4.

Pre-orders are non-binding and you do not have to purchase the goods that you have pre-ordered via cph.dk/shop. If you do not want to purchase the pre-ordered goods, do not pick them up.

When you pick up and pay for the goods, you will receive your receipt for the purchase.

cph.dk/shop reserves the right to cancel the contract of pre-order in one of the following situations, without being liable for compensation or other costs:

  • Your payment details are incorrect or cannot be verified
  • Your order is placed with the purpose of committing fraud etc. or is placed in connection with a criminal offense or other unlawful activities
  • There is an inadvertent error on cph.dk/shop, such as a payment error or the like
  • The cph.dk/shop has reason to believe that you are under the age of 18
  • The goods are sold out/not available

You may order only household quantities. If you place several orders within 30 days, the limit applies for all the orders together. The following upper limits apply:

  • Max. 3 units per article from the perfume and cosmetic range
  • Max. 24 bottles per article from the spirits range
  • Max. 60 bottles per article from the wine, sparkling wine or champagne range
  • Max. 99 units per article from the fine food & confectionery range.

4. PURCHASE VIA CPH.DK/SHOP

Via cph.dk/shop you can also purchase goods online. Hereafter you can pick up the good at selected TAX FREE shops, see above under clause 3, or you can have it sent to the delivery address specified by you in the order.

Before submitting the order, you have the option of changing the information that you have provided, including delivery and billing information, or payment information. You also have the option to change or remove goods from your shopping basket.

When you click "Continue" at the end of the ordering flow, a receipt appears on your screen. From this point you are bound by the contract of purchase.

Please contact CPH Customer Service if you made a mistake while placing your order - they are ready to help you. You can find the contact information under clause 1.
You will hereafter receive an email confirming your order, in which you also will find the contact information for Heinemann.

When the goods are shipped to you, you will get a receipt regarding the dispatch. If you pick up the goods at the selected TAX FREE shops, you will get the receipt when you pick up the goods.

cph.dk/shop reserves the right to cancel the contract of purchase in one of the following situations, without being liable for compensation or other costs:

• Your payment details are incorrect or cannot be verified
• Your order is placed with the purpose of committing fraud etc. or is placed in connection with a criminal offense or other unlawful activities
• There is an inadvertent error on cph.dk/shop, such as a payment error or the like
• The cph.dk/shop has reason to believe that you are under the age of 18
• The goods are sold out/not available

5. PRICES

The prices on cph.dk/shop are listed in Euro, Norwegian kroner and Danish kroner, however, you always pay in Danish kroner (DKK).

All the listed prices for goods, delivery costs, and other costs include taxes and value-added taxes.

You must pay the costs relating to delivery, which will be added to the price of your order. The delivery costs vary depending on the chosen method of delivery and will always be listed before you are asked to complete the purchase.

6. PAYMENT

On cph.dk/shop, you may pay by the following means of payment:

• Dankort
• Visa Card
• Mastercard
• JCB
• Maestro

6.1 Payment procedure

Your payment will be debited on the selected means of payment once your goods leave the warehouse to be delivered.

In connection with the completion of the payment transaction, your payment information will be stored until the individual payment transactions are completed. Your payment and card information is saved at CPHs PCI (Payment Card Industry - Data Security Standard) certified partner ePay. The information is stored in a safe PCI certified environment that meets the international security standards until payment operations are completed.

If the chosen means of payment involve a fee for the payment transaction, the fee will be imposed on each payment transaction. You will always be able to see the full amount to be debited before you accept your purchases.

Please note that the rules applying to your payment card also apply when you shop through cph.dk/shop.

7. DELIVERY

Goods will be delivered by PostNord to delivery addresses in Denmark (not Greenland and the Faroe Islands). Delivery is only possible to residential and business addresses, as well as to packages boxes. PostNord's terms for delivery will apply for the delivery to your packages box.

The time of delivery depends on the delivery address and PostNord's delivery time. The estimated delivery time will appear before you are asked to complete the purchase.

Please note that the risk of loss of or damage to the goods passes to you after delivery. If the package appears to be damaged, you should refuse to receive the goods. If you wish to complain about any non-conformity, you are required to give notice to Heinemann. Please read more under "Non-conforming goods and incorrect goods" in clause 9.

7.1 Separate deliveries

Heinemann may choose to make separate deliveries, for example if certain goods are delayed or out of stock at the time of order. You will be informed if your order is subject to separate deliveries. You will not be charged with additional delivery costs for separate deliveries.

Payment for the good in the separate delivery will be debited once these goods have been shipped.

7.2 Order tracking and view history

If you have or create a CPH profile account, you can track your order by visiting the https://shop.cph.dk/en-gb/my-account/all-my-orders and click on "My orders". Here you can also view your order history and check the status of your current orders.

If you do not have a CPH profile user account, you may contact Heinemann for information about the status of your order. Please state your order number when contacting the them.

8. RIGHT OF WITHDRAWAL (ONLY APPLICABLE TO CONSUMERS)

You have the right to withdraw from a purchase without reason within 14 days. The withdrawal period will expire 14 days after the date on which you or a third party indicated by you (other than the carrier), acquires physical possession of goods. If you have purchased multiple goods in an order, you can choose to withdraw from the purchase of some or all the goods.

If you purchased multiple goods in one order, and these cannot be delivered at the same time, the withdrawal period will be calculated from the date on which you or a third party indicated by you (other than the carrier) acquires physical possession of the last goods.

If the deadline expires on a public holiday, Saturday, Constitution Day ("Grundlovsdag"), Christmas eve or New Year's Eve, the deadline is extended to the following weekday.

8.1 Exeption to the right of withdrawal

Please note that there are certain goods for which the right of withdrawal does not apply, for example:

• Sealed goods that are not suited for return due to concerns for public health and hygiene, and where the seal has been broken after delivery. This applies, among other things, to certain cosmetic products, including make-up. If you breake the sealing, you lose your right of withdrawal.
• Alcoholic beverages, where the price was determined when the purchase contract was entered, and where delivery takes place after 30 days, and where the actual value depends on the market circumstances, over which Heinemann has no control.

8.2 How to exercise your right of withdrawal

To exercise the right of withdrawal, you must send an email or a letter to Heinemann (see contact information in your order confirmation and receipt or clause 2 in these terms and conditions), in which you write, that you wish to withdraw from your purchase. You may use the standard withdrawal form below, but it is not mandatory.

The withdrawal deadline is met if you send your notice of withdrawal before the withdrawal period has expired.

If you have chosen to pick up goods in one of the selected TAX FREE shops, see more under clause 3, and you do not pick up the goods within the deadline determined by Heinemann, this will be considered as an exercise of your right of withdrawal.

8.3 Returning the goods

If you withdraw from your purchase, you must return the goods by carrier to Heinemann at the specified physical address in the order confirmation and your receipt of purchase. You have to return the goods without undue delay and in any event no later than 14 days from the day on which you communicate your withdrawal from your purchase to Heinemann. The deadline is met if you return the goods before the period of 14 days has expired.

Return of the goods is free of charge when you use the return label, which is included in the package from Heinemann.

The goods must be packaged properly and in original wrappers. Lack of original packaging may be a depreciation, so we recommend that the goods be returned in original packaging.

The return label is then attached to the package with the return goods and the package is delivered to the post office.

You are liable for the package until it is received by Heinemann. It is therefore recommended that you keep the post office receipt as proof of your delivery of the package to the post office

8.4 Reimbursement

When Heinemann has received the goods, you will receive an email confirmation. Heinemann will reimburse all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by Heinemann), without undue delay, and in any event not later than 14 days from the day on which Heinemann is informed about your decision to withdraw from this contract.

Heinemann will make the reimbursement using the same means of payments as you used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not have to pay any fees because of such reimbursement.

If you withdraw from part of the purchase, you will only be reimbursed for delivery costs insofar as delivery costs would have been less without delivery of the part from which you have withdrawn, or if you have withdrawn from the entire purchace.

Heinemann may withhold reimbursement until it has received the goods back, or you have supplied evidence of having sent back the goods, whichever is the earliest.

You are only liable for any diminished value of the goods resulting from the handling of the goods other than what is necessary to establish the nature, characteristics, and functioning of the goods. You may therefore examine the goods in the same way, as one can and may in a store, but you may not bring the goods into use.

9. NON-CONFORMING GOODS AND INCORRECT GOODS

The rules on non-conforming goods in the Danish Sale of Goods Act apply to your purchase, and you can therefore complain over non-conformity of goods within 2 years from the date of delivery.

If your goods are non-conforming or Heineman has delivered incorrect goods, please contact Heinemann within a reasonable period of time after having noticed the non-conformity/the incorrect goods (see the contact information in you order confirmation or receipt). If you notice non-conformity or incorrect goods at the time of delivery, you should refuse to receive the goods.

When contacting Heinemann, you have to provide the order number, possibly the item number, and to describe what is wrong with the goods etc.

You are not responsible for costs associated with returning non-conforming goods or incorrect goods. The non-conforming goods and incorrect goods must be properly packaged and we recommend that you obtain a receipt for delivery of the package at the post office.

10. ACCESS TO THE CONTRACT

CPH and Heinemann store the concluded contracts, including the order confirmation, for as long as it is necessary in the interests of Heinemann's contractual obligations to you, or necessary for reasons of legal obligations. It is recommended that you keep these documents as well; they may not necessarily be available on the cph.dk/shop subsequently.

11. MEASURES AGAINST FRAUD

In order to protect you against fraud and to maintain a high level of security for online purchases, CPH may carry out verification checks. The verification check may comprise the data that you send when ordering through cph.dk/shop, including your address and payment information. The verification check will comprise, that you enter your 7-digit PNR (Passenger Name Record). If this is required, you will be informed about this during the entering of your information.

12. OTHER MATTERS

12.1 Updating cph.dk/shop

cph.dk/shop is open 24 hours a day, but may be closed due to maintenance.

We will do our best to update cph.dk/shop and to ensure that prices, offers, descriptions, and other information concerning the goods are correct. Typographical errors, sold out goods, and errors in prices, offers, descriptions, and other information concerning the goods may occur, and sometimes it is discovered that the prices of the goods are incorrect. Therefore, reservations are made for such errors, including typographical errors and sold out goods, as any claims in relation to the above must, however, be addressed to Heinemann and is unconnected to CPH

12.2 Force Majeure

Heinemann is not responsible for any delays or failure to meet Heinemann's obligations in relation to the terms and conditions, if the delay or the non-compliance is due to events beyond Heinemann's reasonable control.

12.3 The completeness of the contract

These terms and conditions constitute the complete terms of the contract between you and Heinemann.

12.4 Assignment

Heinemann is entitled to assign its rights and obligations under the contract with you to third parties. The assignment naturally presupposes that the standard of the service you receive is not impaired. Heinemann will notify you of such possible assignment. By accepting these terms, you consent to any such future assignment. At the same time, you agree that from the time when Heinemann has given you notification of the assignment, your rights may be claimed only against the third party in question.

13. PRIVACY POLICY

Heinemann and CPH process your personal data confidentially. Please read the Privacy Policy that explains how CPH uses the personal data that you provide in connection with your use of cph.dk/shop. In order to complete your pre-order or purchase, CPH will disclose your personal data to Heinemann.

14. RIGHT TO COMPLAIN

If you wish to complain about goods purchased at Heinemann via cph.dk/shop, please contact Heinemann. You can find the contact information on your order confirmation and on your receipt or in clause 2 of these terms and conditions.

If you cannot reach an agreement with Heinemann, you may also submit a complaint to the The Danish Competition and Consumer Authority's Center for Dispute Resolution, Nævnenes Hus, Toldboden 2, 8800 Viborg, Denmark, if your purchase fulfil the requirements,see more information on www.forbrug.dk and http://www.kfst.dk/forbrugerforhold/klageforhold/center-for-klageloesning/.

You may also use the European Commission online complaints register when submitting your complaint. This is particularly relevant if you are a consumer residing in another EU country. You may submit the complaint by using the following link: http://ec-europa.eu/odr.

When submitting the complaint, you must state Heinemann's email address as specified on the order confirmation and receipt for the purchase.

In case no settlement can be reached through the Center for Dispute Resolution, you will have access to submit a complaint to the Consumer Complaints Board.

14.1 Choice of law and jurisdiction

Any contracts concluded between Heinemann using these terms and conditions are governed by Danish law, if possible pursuant to applicable law, and any dispute that may arise must be brought before a competent court in Denmark.
